Terms of Service
These terms govern use of TabFellow at tabfellow.com, operated by Hutts Enterprises. By creating an account or using the service you agree to them.
1. The service
TabFellow is a hosted point-of-sale application for restaurants: register, tickets, kitchen display, tables, reservations, guest ordering, and reports. Each account gets an isolated tenant database.
2. Subscriptions and billing
- Accounts start with a 14-day free trial. Continued use after the trial requires a paid subscription.
- Paid plans are billed as a subscription through Stripe in US dollars. Pricing is by location bracket (for example Independent 1–5 locations, Growing 6–15), with monthly and annual options as published on the pricing page. Annual billing is 10× the monthly rate.
- Taxes, Stripe processing fees, and card-present (Connect) arrangements are separate from the subscription.
- You may cancel at any time; the subscription stays active until the end of the paid period and no further renewals are billed. Fees already paid are not refunded except where required by law.
- If a paid plan lapses, the account is frozen at the last build your plan entitled you to until you subscribe again. Your data is not deleted for a reasonable grace period.
- We may change pricing for future billing periods with notice before your renewal.
3. Your data and responsibilities
- You keep accurate account information and keep credentials confidential. Staff get their own logins; you are responsible for what your users do.
- Order, menu, customer, and sales data you enter belongs to you, the restaurant. You are the controller of your guests' personal data and are responsible for lawful collection, including any required notices and consent.
- You are responsible for tax configuration, prices, and complying with payment-card, tipping, and food-service rules that apply to you.
4. Acceptable use
- No unlawful, deceptive, or harmful activity; no reselling access; no scraping or probing other tenants' data.
- No attempting to disrupt the service, bypass plan limits, or misuse the demo beyond evaluation.
- We may suspend accounts that violate these terms or create risk for other customers.
5. Service terms
- We aim for high availability but do not warrant uninterrupted service. Keep your own records where the law requires them (for example, tax filings).
- We may update the software; entitled versions follow the plan terms described on the pricing page.
- Demo kitchens are evaluation-only, expire after about 36 hours, and may be deleted.
6. Disclaimers and liability
The service is provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, Hutts Enterprises is not liable for indirect, incidental, special, or consequential damages, lost profits, or lost data. Our aggregate liability for any claim relating to the service is capped at the amount you paid us in the twelve months before the claim.
7. General
These terms are governed by the laws of the State of Texas, excluding conflict-of-law rules, and disputes will be brought in the state or federal courts located in Texas. If a provision is unenforceable the rest still apply. Questions: [email protected].
